Newsletter Terms and Conditions

TERMS AND CONDITIONS OF THE WALL ART SP. Z O.O. NEWSLETTER SERVICE

  1. Wall Art Sp. z o.o., with its registered office in Wrocław (hereinafter also referred to as the Service Provider) provides the Newsletter service under the terms set out in these Terms and Conditions.
  2. Newsletter means an electronic distribution service provided by
    Wall Art Sp. z o.o., with its registered office in Wrocław, via e-mail, which enables all persons using it to automatically receive recurring content from subsequent editions of the Newsletter containing information about Wall Art products, new arrivals, promotions, competitions, events,
    and collections. The service is provided under the terms described in these Terms and Conditions.
  3. The Newsletter service may be used by a natural person, a legal person acting through an authorized representative, or an organizational unit without legal personality to which the law grants legal capacity, possessing full legal capacity (hereinafter also referred to as the “Service User”). 
  4. The controller of the personal data provided during registration is
    Wall Art Sp. z o.o., with its registered office in Wrocław, ul. Ćwiczebna 4, 51-180 Wrocław.
  5. Providing the data is required to provide the Newsletter service, and failure to provide it makes it impossible to send the Newsletter. Personal data may be shared with our business partners acting on our behalf
    and supporting us in providing the Newsletter service.
  6. Personal data is processed: 
  1. for the purpose of providing the Newsletter distribution service – the legal basis for processing is the necessity of processing to perform the agreement (Article 6(1)(b) of the GDPR); 
  2. where marketing content is directed to the User as part of the Newsletter – the legal basis for processing, including profiling, is the legitimate interest of the Controller (Article 6(1)(f) of the GDPR) in connection with the consent given to receive the Newsletter; 
  3. for analytical and statistical purposes – the legal basis for processing is the legitimate interest of the Controller (Article 6(1)(f) of the GDPR), consisting in analyzing User activity on the relevant Service to improve the functionalities used; 
  4. for the potential establishment and pursuit of claims or defense against them – the legal basis for processing is the legitimate interest of the Controller (Article 6(1)(f) of the GDPR).
  1. Use of the Newsletter service is possible after the Service User completes the following consecutive steps:
  1. providing their e-mail address in the appropriate field on the Service, or selecting the appropriate checkbox to receive commercial information through the relevant channel;
  2. accepting the provisions of these Terms and Conditions (including by clicking the activation link sent by the Service Provider to the e-mail address provided by the Customer – where this functionality has been made available). The Service Provider may also provide other methods of accepting the provisions of these Terms and Conditions.
  1. By subscribing to the Newsletter, the Customer consents to Wall Art Sp. z o.o. sending advertisements and commercial information, as understood under the Act of 18 July 2002 on the Provision of Services by Electronic Means, to the User’s e-mail account via the Newsletter.
  2. Use of the service requires a device with Internet access, any web browser, and an active, properly configured e-mail account.
  3. The Newsletter service is provided for an indefinite period.
  4. The Service Provider does not charge Service Users any fees for providing the Newsletter service.
  5. The Service User is obliged in particular to:
  1. provide the Service Provider only with true, current, and all necessary Service User data;
  2. immediately update the data provided to the Service Provider in connection
    with entering into the Agreement.
  1. The Service User has the right to access their personal data, including requesting a copy thereof, requesting rectification, restriction of processing, or erasure of their data, and to withdraw from the Newsletter service, transfer their personal data, for example to another controller, and lodge a complaint with the President of the Personal Data Protection Office. Additional information concerning personal data protection is contained in the “Privacy Policy” available on the Service.
  2. The Service User may unsubscribe from the Newsletter service (withdraw from the service) at any time and without giving a reason, in particular by clicking the deactivation link included in every e-mail sent to the Service User as part of the Newsletter service or by clicking the relevant button on the Service page, the link to which is included in the first message sent to the telephone number provided in connection with registration for the Newsletter service. 
  3. The Service Provider may terminate the Agreement with one month’s notice
    in the following cases:
  1. changes in the legal provisions governing the provision of services by electronic means by the Service Provider that affect the mutual rights and obligations specified
    in the Agreement,
  2. changes in the method of providing the services due to technical or technological considerations (in particular, updates to the technical requirements specified in these Terms and Conditions); 
  3. changes to the scope or provision of services covered by the Newsletter service.

The Service Provider shall send the statement referred to above to the e-mail address or telephone number provided by the Service User during registration for the Newsletter service.

  1. If the Service User has reservations concerning the Newsletter service, the Service User may exercise the right to lodge a complaint. The Service Provider shall respond to the complaint promptly, no later than 14 days from the date it was submitted.
    Complaints related to the provision of the Newsletter service may be submitted by e-mail to: biuro@wallart.com.pl or by post to the Company’s registered office: ul. Ćwiczebna 4, 51-180 Wrocław. 
  2. The Newsletter service agreement is governed by Polish law.
  3. These Terms and Conditions constitute a standard-form agreement within the meaning of Article 384 § 1 of the Civil Code of 23 April 1964 (consolidated text: Journal of Laws of 2020, item 1740, as amended).
  4. These Terms and Conditions are available free of charge at https://wallart.com.pl/ in a form that enables the content of these Terms and Conditions to be obtained, reproduced, and recorded using the ICT system operated by the User. The content of the agreement concerning the “Newsletter” service is recorded, secured, and made available by sending the Customer the content of the agreement to the e-mail address provided during registration.
  5. The Service Provider reserves the right to amend these Terms and Conditions, of which it shall notify Service Users by e-mail. Amendments to the Terms and Conditions shall enter into force on the date specified together with the information about the amendment, but not earlier than 14 calendar days after the Users have been informed of the amendments.
